Inscription a la CNIL
Cet article est là pour tenter de vous aider à remplir le formulaire de déclaration en ligne de la CNIL.* Etape I-indentification : dans le premier champ, mettez les url de votre site (nom de domaine, url réelle,...)
vous déclarez : cochez la bonne case. (si cela concerne une modification ou suppression, indiquez le n° fourni dans le courrier de la CNIL) le cadre suivant vous concerne si votre site partage des données avec un autre de vos sites déjà déclarés. Dans "vous êtes", vous indiquez que vous êtes une personne morale vous cochez le premier cas, ou alors si vous faites la déclaration pour le compte d’une société ou d’une association, c’est le second cas que vous devez cocher. Si c’est en tant que personne morale et physique remplissez les champs "nom ou raison sociale"(nom de famille), "nom usuel ou sigle"(prénom), adresse, code postal, localité, téléphone et e-mail.
Le service auprès duquel s’exerce le droit est soit vous-même (donc votre nom), soit votre site (le nom de votre site).
* Etape II-Hébergement de votre site : indiqué si vous l’hébergé vous-même ou chez un fournisseur : dans ce cas mettre l’adresse de l’hébergeur.
o Etape interactive : si votre site à besoin d’un enregistrement des internautes, vous collectez des données relatives à ce derniers, donc cochez "oui".
* Etape III-Recueil d’informations auprès des visiteurs du site : ici indiquez toutes les informations que vous collectez sur chaque membre. Suivre pas à pas, cette étape est assez facile. Concernant la conservation des données, pour ma part j’indique la mention : "vie du site"
o Etape interactive : si vous disposez d’un forum cochez oui.
o Etape III-2 : indiquez que votre forum est modéré (conseillé).
o Etape III-3 : si le public peut avoir accés aux informations des membres, cochez oui, dans le cas contraire non.
+ Etape interactive : si les visiteurs non inscrit peuvent avoir leur informations (ex : IP) visible pas les autres, alors vous devez mettre oui.
o Etape interactive IV : si votre site propose des services ou des rubriques à accés restreint (non visible par tout le monde) alors cochez oui, sinon c’est non.
* Etape IV-Accés restreint à certains services de votres site : cochez les bonnes cases correspondantes à la restriction de vos services.
o Etape interactive : assurez-vous la sécurité des échanges de données personnelles ? Pour ma part je mets non. Car je ne peux assurer de maitriser complétement cet échange.
o Etape interactive : utilisez vous des procédés de collecte automatisée de données (dans la plupart des cas, pour les CMS, c’est oui)
* Etape V -Procédé de collecte automatisée des données : indiquez quel type de collecte, la durée de cette collecte (60 mn, 1jr,...) et si celle ci est obligatoire pour l’accés au site. Pour l’intégralité du site c’est oui.
o Etape interactive : utilisez-vous des profils des visiteurs de votre site ?
Si ceux-ci doivent s’identifier et on rempli un formulaire, alors cochez "oui".
o Etape V-2 : établissement du profil des visiteurs : remplissez les 3 bons champs.(par exemple : informations qu’il a fourni lui-même, des cookies, non)
o Etape interactive : exploitez-vous les données de connexions de votre site ?
Si vous ne constituez pas une liste de ces données pour une diffusion publique, cochez non.
* Etape Finale : indiquez votre NOM et votre fonction (ex : webmestre, rédacteur, créateur du site, designer, graphiste, etc...)
Votre déclaration est maintenant terminée, vous pouvez l’imprimer avant de l’envoyer. Quelques jours après vous recevrez un courrier confirmant votre inscription : conservez bien ce courrier ! !
